Rome Civil Court Orders Medical Evaluation for Vittorio Sgarbi

Rome, January 27 – The Rome Civil Court has ordered a medical evaluation for art critic and politician Vittorio Sgarbi. The purpose of the evaluation is to determine whether Sgarbi is “capable of understanding the personal, patrimonial, and legal implications and consequences of decisions of particular complexity and relevance.” The decision was ratified as part of proceedings initiated by Sgarbi’s daughter, Evelina, who requested the appointment of a support administrator for her father.

New Assessments to Be Completed by May 31

The judge has appointed an official technical consultant, a psychologist-psychotherapist, to “ascertain, after examining the documents, conducting the necessary examinations, acquiring existing health documentation, and obtaining information from the healthcare professionals who have treated the beneficiary, whether Sgarbi presents psychological, psychopathological, or cognitive conditions that affect his capacity for self-determination in relation to extraordinary administration acts and the exercise of highly personal rights.” The expert assessment must be completed by May 31.

Daughter’s Lawyer Expresses Satisfaction

“We are satisfied. Judge Paola Scorza has scheduled the first hearing for Professor Vittorio Sgarbi by February 15 of this year,” stated lawyer Lorenzo Iacobbi, representing Evelina Sgarbi. “The CTU (official technical consultant) will therefore have access to the professor’s medical records, despite Professor Sgarbi’s defense, represented by lawyer Ruffolo, having repeatedly and insistently requested that everything be kept confidential, verbally reiterating a request that the judge had already rejected in writing. Naturally, as Evelina Sgarbi’s defense, we opposed this request, which in our opinion makes no sense and moreover openly violates the adversarial principle. We are satisfied that the judge again rejected colleague Ruffolo’s request, denying the secrecy of the documents and thus allowing the CTUs to access the medical records.”

Iacobbi further elaborated on the motivation behind the request: “We care about the Professor’s health. We want to save the man, not the character. We have reiterated from the outset that this is not an economic dispute. Evelina does not need any kind of action; she is already in the inheritance line. The judge has set deadlines, so by May, we should have a definitive result. Certainly, if Evelina had been accommodated 18 months ago and given the opportunity to know her father’s health conditions, we would not be here today discussing it. This wall of privacy was erected, and so we were forced to turn to the Court. Her father was hospitalized in truly desperate conditions. As a daughter, it is only right that she knows her father’s real health conditions.”
