Monaldi Hospital in Naples Ordered to Pay Over €300,000 for Patient’s Death
Naples, March 21, 2026 – The Monaldi Hospital in Naples, part of the Azienda Ospedaliera dei Colli, has been ordered to pay more than €300,000 in compensation to the family of an elderly patient who died approximately two years ago. The ruling follows an investigation that revealed significant deficiencies in patient care, specifically regarding fall prevention and infection control.
The patient was initially admitted to the hospital for non-alarming symptoms, including weakness and low blood pressure. However, during her stay, her condition rapidly deteriorated after she suffered a fall within the facility, resulting in a fractured femur. This injury significantly worsened her overall health.
Complications and Fatal Outcome
Following the fall, the patient contracted multiple nosocomial (hospital-acquired) infections, which led to a progressive decline in her health. Despite her already compromised state, she underwent surgery. Tragically, approximately ten days after the operation, fatal complications arose, leading to her death.
Legal Action and Expert Findings
The patient’s family, represented by lawyers Pierlorenzo Catalano, Michele Sorrentino, and Filippo Castaldo from Studio Associati Maior, initiated legal proceedings. A technical assessment conducted by court-appointed consultants confirmed the family’s claims, highlighting severe shortcomings in the management of both fall risk and infectious risk.
Specifically, the assessment identified the absence of adequate safety devices, patient alert systems, and proper nursing supervision. Furthermore, the hygienic-sanitary conditions were deemed insufficient to prevent the spread of hospital-acquired infections.
The Court’s Decision and Lawyers’ Statement
Given the findings of the technical assessment and the absence of a settlement agreement, a merit judgment was initiated solely for the quantification of damages. The proceedings concluded with a favorable verdict for the family, who were awarded substantial compensation exceeding €300,000.
